AUSTRALIA GOLF, REEF AND RAINFOREST SWEEPTAKES
DOWN UNDER ENDEAVOURS – LUXURY VACATION SWEEPSTAKES
NO PURCHASE NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES
OPEN TO ALL LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE AT LEAST 21 YEARS OLD AS OF THE DATE OF SUBMISSION.
The Down Under Endeavours Australia Golf, Reef and Rainforest Sweepstakes (“Sweepstakes”) is sponsored by Down Under Endeavours, Inc. (“Sponsor” or “Down Under Endeavours”). By entering this Sweepstakes, participants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification. All decisions of the Sweepstakes judges regarding this Sweepstakes are final and binding in all respects.
1. SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00:01 AM Eastern Time (“ET”) on June 24, 2022 and ends at 11:59:59 PM ET on July 15, 2022.
2. ELIGIBILITY: The Sweepstakes is only open to legal residents of the 50 United States and the District of Columbia who are 21 years old as of the date of submission, except any officers, directors, members, affiliates, and employees of Down Under Endeavours, or any other party associated with the development or administration of this Sweepstakes, and the immediate family (i.e., parents, children, siblings, spouse), and any persons residing in the same household as such individuals. Void where prohibited.
3. HOW TO ENTER: Submit your first name, last name, email address, phone number, and name of home club (if applicable) to Down Under Endeavours. One entry per person allowed. Participant agrees that by entering the Sweepstakes, Sponsor may use the contact information Participant expressly provides (with express authorization) for marketing purposes and with express authorization for Sponsor to contact Participant regarding the Sweepstakes in accordance with any and all applicable laws.
4. WINNER SELECTION AND NOTIFICATION: Down Under Endeavours will randomly select a winner on or around July 18, 2022. The winner will be notified directly. If the first chosen winner does not respond within forty-eight (48) hours of such notification, such potential winner forfeits all rights to win the Sweepstakes and/or to receive the prize and an alternate potential winner may be selected. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Sweepstakes, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the “Winner” of the Sweepstakes.
5. PRIZE DESCRIPTION: The prize shall consist of: 3 Nights Silky Oaks Lodge Rainforest Retreat, Private transfers roundtrip to Silky Oaks Lodge, 2 Nights Lizard Island Beachfront Suite, Roundtrip flights to Lizard Island, 2 Nights ShangriLa Cairns Deluxe Sea View Room, 1 Round of Golf for Two at Mirage Country Club (includes clubs and cart), Private transfers roundtrip to ShangriLa Cairns.
6. TAXES: All federal, state and/or local income and other taxes, if any, are the Winner’s sole and exclusive responsibility.
7. NO PRIZE TRANSFER OR SUBSTITUTION: The prize (“Prize”) is not transferable or redeemable for cash. No substitutions are allowed for Prize except as decided exclusively by Down Under Endeavours, in which case a Prize of equal or greater value may be substituted.
8. CONSENT AND RELEASE: By entering the Sweepstakes, each Participant releases and discharges Down Under Endeavours and any other party associated with the development or administration of this Sweepstakes, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Down Under Endeavours Entities”), from any and all liability whatsoever in connection with this Sweepstakes, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”). Except where prohibited: (i) acceptance of a prize constitutes the consent of any Winner, without further compensation, to use the name and likeness of such winner for editorial, advertising and publicity purposes by Down Under Endeavours and/or others authorized by Down Under Endeavours; (ii) acceptance of the Prize constitutes a release by any Winner of the Sweepstakes of any and all Claims in connection with the administration of this Sweepstakes and the use, misuse, or possession of any prize; (iii) any potential Winner of the Sweepstakes may be required to sign an affidavit of eligibility (including social security number) and a liability/publicity release; and (iv) if Prize involves travel or activities, any potential winner and travel companion (if applicable) of the Sweepstakes may be required to execute releases of Down Under Endeavours Entities from any and all liability with respect to participation in such travel/activities and/or use of the Prize. Affidavits and releases must be returned to Down Under Endeavours within five (5) days from the date that Down Under Endeavours first tries to notify the potential Winner; failure to follow and meet these requirements shall result in forfeiture of the Prize.
9. DISCLAIMERS: (i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, will not be eligible. (ii) Down Under Endeavours, in its sole discretion, reserves the right to disqualify any person tampering with the entry process. (iii) Down Under Endeavours reserves the right to cancel, terminate, or modify the Sweepstakes if it is not capable of completion as planned, including by reasons of tampering or force majeure. (iv) Down Under Endeavours Entities are not responsible for errors in the administration or fulfillment of this Sweepstakes, including without limitation mechanical, human, printing, distribution, or production errors, and may modify or cancel this Sweepstakes based upon such error at its sole discretion without liability. (v) THE PRIZE IS PROVIDED “AS-IS” AND DOWN UNDER ENDEAVOURS ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS SWEEPSTAKES OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. (vi) CAUTION: ANY ATTEMPT BY A PARTICIPANT TO UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, DOWN UNDER ENDEAVOURS ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION, if applicable.
10. APPLICABLE LAWS AND JURISDICTION: This Sweepstakes is subject to all applicable federal, state, and local laws and regulation. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Illinois. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by a state or federal court in Cook County, Illinois. Should there be a conflict between the laws of the State of Illinois and any other laws, the conflict will be resolved in favor of the laws of the State of Illinois. All judgments or awards shall be limited to actual out-of-pocket damages associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
11. DATES: Trip dates are subject to availability and Down Under Endeavours reserved the right to schedule dates according to availability at the properties. Valid for travel up to 31 March 2023.
12. BLACKOUT DATES: Package is not available for 22 December 2022 – 08 January 2023.
13. WINNER LIST: For Winner’s name, send a self-addressed stamped envelope, within six (6) months of the Sweepstakes Period, to: Down Under Endeavours, 5315 North Clark Street, #615, Chicago, IL 60640.
